After DACA Ruling, Law Enforcement Urge Solution from Congress

WASHINGTON, D.C. — Today, the 5th Circuit ruled against the Deferred Action for Childhood Arrivals (DACA) program, siding with a lower court’s ruling that the policy is unlawful.

The ruling sends the case back to the lower court to determine the legality of the Biden administration’s new rule fortifying DACA, which is slated to take effect on October 31. The 5th Circuit’s ruling, however, allows about 600,000 DACA recipients to maintain their protections pending a likely appeal to the U.S. Supreme Court, while continuing to block new applicants.

“Today’s ruling means that it is more urgent than ever for Congress to act. DACA recipients are contributing members of our communities and deserve to feel safe in the country they call home. I urge lawmakers to enact meaningful immigration reform that protects Dreamers permanently,” said Police Chief Ramon Batista of Santa Monica, California.

“Eliminating DACA and forcing hundreds of thousands of immigrants back into the shadows will make law enforcement’s job even tougher. DACA protects not just Dreamers, but also the communities in which they live. It has been a helpful tool for law enforcement seeking to build trust with immigrant communities and has made immigrants feel safer reporting crimes,” said LEITF co-chair Sheriff Ed Gonzalez of Harris County, Texas.

“With DACA at risk, so too is public safety. If immigrants fear that interacting with law enforcement may lead to their deportation, they are likely to hesitate to report crimes. Knowing this, criminals may target immigrant communities and exploit this fear. For the safety of all, Congress must find a permanent legislative solution,” said Police Chief Mike Tupper of Marshalltown, Iowa.
